Ferch is an AI-powered personal assistant that provides suggestions, recommendations, scheduling assistance, and general information. The Service uses third-party artificial intelligence models to generate responses. Ferch is provided "as is" and "as available."
The Service does not provide medical, legal, financial, tax, or any other form of professional advice. All information, suggestions, recommendations, and responses generated by Ferch are for general informational and entertainment purposes only. You should not rely on any information provided by the Service as a substitute for professional advice. Always consult a qualified professional for matters that require expert guidance.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, RELIABILITY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.
We make no guarantees regarding the accuracy, reliability, completeness, or timeliness of any information, recommendations, suggestions, or content generated by the AI. AI-generated content may contain errors, inaccuracies, outdated information, or hallucinations (fabricated information presented as fact).
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FERCH, ITS OWNERS, OPERATORS, AFFILIATES, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.
THIS INCLUDES, WITHOUT LIMITATION, LIABILITY FOR: (A) ANY INFORMATION, RECOMMENDATIONS, OR SUGGESTIONS PROVIDED BY THE AI; (B) ANY ACTIONS TAKEN OR NOT TAKEN BASED ON AI-GENERATED CONTENT; (C) ERRORS, INACCURACIES, OR OMISSIONS IN AI RESPONSES; (D) SCHEDULING ERRORS OR MISSED REMINDERS; (E) INCORRECT RECIPES, DIETARY INFORMATION, OR FOOD-RELATED SUGGESTIONS; (F) ANY FINANCIAL DECISIONS MADE BASED ON INFORMATION FROM THE SERVICE; (G) ANY HEALTH OR SAFETY CONSEQUENCES FROM FOLLOWING AI SUGGESTIONS; (H) DATA LOSS OR CORRUPTION; (I) UNAUTHORIZED ACCESS TO YOUR ACCOUNT.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY US DOLLARS ($50.00), WHICHEVER IS GREATER.
You are solely responsible for: (a) verifying the accuracy of any information provided by the Service before acting on it; (b) maintaining the confidentiality of your account credentials; (c) all activity that occurs under your account; (d) ensuring your use of the Service complies with all applicable laws and regulations; (e) any consequences resulting from your reliance on AI-generated content.
You agree not to use the Service to: (a) violate any applicable laws; (b) generate harmful, abusive, threatening, or illegal content; (c) attempt to reverse-engineer, exploit, or circumvent any security measures; (d) impersonate others; (e) transmit malware or other harmful code; (f) use automated means to access the Service beyond its intended interface; (g) resell or redistribute access to the Service without authorization.
You agree to indemnify, defend, and hold harmless Ferch, its owners, operators, affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) any actions taken based on AI-generated content; (d) your violation of any rights of a third party.
You expressly acknowledge and agree that your use of the Service is at your sole risk. You understand that the Service uses artificial intelligence that may produce incorrect, incomplete, misleading, or inappropriate responses. You assume full responsibility for evaluating the accuracy, completeness, and usefulness of any information provided by the Service.
We reserve the right to suspend or terminate your access to the Service at any time, for any reason, without notice or liability. Upon termination, your right to use the Service will immediately cease.
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
You have the right to: (a) access your personal data at any time through the Settings page; (b) export a copy of all your data in machine-readable format; (c) request deletion of your account and all associated data; (d) withdraw consent for data processing by deleting your account. We will process data deletion requests within 30 days. These rights are provided in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable privacy regulations.
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein, without regard to conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Ferch regarding your use of the Service and supersede all prior agreements and understandings.
